Reaching a Consensus Among All Members: The Community Adjudication Panel Is the Best Dispute-Resolution Method for Members, the Platform, and Society
Right now KangAi Commune is focusing on building the member Community Adjudication Panel. One of its core purposes is to find, for all our members and for the platform, a dispute-resolution method that is cheaper, more efficient, fairer, and beneficial to all sides.
All members need to be clear about one thing: once a community dispute goes to court and into litigation, no one benefits.
The vast majority of our members are ordinary-income families, and the amounts involved in disputes arising within the Commune are generally not large. But the cost of going to court is extremely high: you have to pay for a lawyer, spend a great deal of time and energy, and face a lengthy trial period. In the end, the cost of defending your rights often far exceeds the value of the dispute itself. For ordinary users, it is time-consuming, laborious and expensive — extremely poor value.
At the same time, frequent litigation disputes are also a huge drain on the platform. Constantly engaging with litigation procedures and handling all kinds of judicial disputes consumes a great deal of the platform’s manpower, funds and legal resources, which drags down operating efficiency and is not conducive to the Commune’s long-term, stable development.
It can be said that going to court is a lose-lose choice in which users suffer and the platform is depleted.
The emergence of the Community Adjudication Panel has completely changed this situation, achieving benefits for users, a lighter burden for the platform, and a win-win for everyone.
First, for the broad membership, the Community Adjudication Panel is the most considerate, low-cost channel for protecting rights. The Panel is made up of ordinary members like us; we empathize with and understand one another, and know best the real circumstances and difficulties of members. Compared with the cold judicial process, member adjudication has more human warmth, better balances reason and rules, and is more likely to reach a fair, considerate decision for the applicant. With zero litigation cost throughout and no need to expend a great deal of effort, it resolves conflicts quickly and genuinely safeguards every member’s rights.
Second, for the platform, we have the resource advantage of access to professional legal counsel and lawyers. We no longer consume funds and legal resources in inefficient, lengthy litigation; instead, we put those resources to work serving members and adjudicating disputes fairly. This greatly lowers the platform’s dispute-handling costs and reduces unnecessary losses, while also ensuring the platform’s legal resources are truly used where members need them.
Third, for all members of the Commune as a whole, the Community Adjudication Panel is a self-governance system that can endure over the long term in a virtuous cycle. It gives members the right to take part in community governance and to judge disputes themselves, truly realizing “shared governance by members and fair sharing,” so that all disputes can be resolved efficiently and fairly within the community.
Here we also clarify the boundaries of the mechanism: the Community Adjudication Panel is an internal self-governance mediation mechanism of the Commune. It does not replace the judicial route, and its decisions have no judicial binding force. If a member does not accept the adjudication result, they retain the full right to sue and pursue legal proceedings. The Panel merely offers everyone a better, more convenient and gentler front-end channel for resolution.
Based on all the practical considerations above, we hope all members reach a unified consensus:
Using the Community Adjudication Panel to resolve disputes is the best solution — beneficial to users, to the platform, and to all of us.
Only when all members recognize, trust and support the Panel mechanism can we build a long-term, stable and sustainable dispute-resolution system, making the Commune’s mutual-aid atmosphere purer, its governance fairer, and its development more enduring — benefiting every member in the Commune.
